What is an Exclusive Buyers Agent?

An Exclusive Buyer Agent (EBA) is an agent that only represents the interests of the buyer during the process of a home purchase. An EBA does not take listings of any kind, and is therefore the only way to guarantee you are being 100% represented in any house that agent shows you.

"Sellers Agent"

This is the person and company who's name is on the sign. They are commonly called the Listing Agent. They are under legal obligation to represent the sellers interest. ie: Get the highest price, best terms, in the shortest amount of time.
In this case the SELLER is the CLIENT and the buyer is a customer.

"Exclusive Buyers Agent"

This is the person and company who represents the only the interests of the buyer. ie: Locate a home that meets the buyers needs and then disclose all known information about the sellers and use that knowledge to negotiate on behalf of the buyer.
In this case the BUYER is the CLIENT and the seller is a customer.
 
"Dual Agent"
 
This is a person and company that works for both the Seller and the Buyer in the same transaction. In this case the agents have to become "Neutral Parties" and can't give true representation to either party. Because they owe certain duties to both sides of the transaction they by law (ORC 4735.72) must "(2) Refrain from advocating or negotiating on behalf of either the seller or the purchaser;" and since they were hired by each side to preform on their behalf the "Dual Agent" must therefore break promises made to both sides.
In this case both the SELLER and BUYER are CLIENTS.

THE CHOICE IS YOURS!

  • Use an agent that is representing the interests of their client "The Seller"
  • Use an agent that tries to represent both "You" and "The Seller" but by law can't.
  • USE AN EXCLUSIVE BUYER AGENT THAT WILL GIVE "YOU" ADVICE AND ADVOCATE ON "YOUR" BEHALF 100% OF THE TIME!
